The authority of the Constitution was established after it was ratified by the (I believe it had to be 7 of the 13)Thirteen States. What isn't expressly given to the Federal Government is implied to go to the states. The 3 branches had their own powers that check and balance each other out

The US Constitution....and actually, most of Constitutions, establish Authotity thru the Sovereignty...The People, who have the real, total, and primary power, delegate in a Assembly who should make a Constitution; so the Power of the Sovereign (the People) is turned in Authority thru the general aceptation and recognising of that power.
